Background

As a result of the February 19, 2010 raid on Kermit Gosnell's abortion chamber at 3801 Lancaster Avenue, the Philadelphia Medical Examiner (ME) has stored the bodies of 45 of Gosnell's victims. The ME declined offers by local Philadelphia pro-life organizations to release the bodies for burial because the bodies were being held as evidence for Gosnell's trial.

At the conclusion of Gosnell's trial in May 2013, these organizations, along with Philadelphia Archbishop Charles Chaput, renewed this request to release these babies' bodies for burial. The ME again denied these requests without providing a reason. The ME only asserted his legal authority to hold the bodies for ten years and to provide no notice about their disposal to non-family members.
