Supreme Court Justices Seem Skeptical of California Law Impinging on Free Speech Rights of Pregnancy Help Centers

The Supreme Court today heard oral arguments in National Institute of Family and Life Advocates v. Becerra, a much-anticipated free speech case in which pro-life pregnancy help centers say the state of California (as one attorney put it) is attempting to conscript them into “acting as a ventriloquist’s dummy for a government message”—abortion.

In their accounts, two major newspapers—the New York Times and the Los Angeles Times—along with NPR, stressed that the so-called Reproductive FACT Act had been met with skepticism across the High Court’s ideological spectrum

The New York Times’ Adam Liptak began his story, 

“A California law that requires ‘crisis pregnancy centers’ to provide information about abortion met a skeptical reception at Supreme Court arguments on Tuesday. Justices across the ideological spectrum said they suspected that the law had singled out centers run by opponents of abortion. Justice Elena Kagan said she feared that the law had been ‘gerrymandered’ to address only some providers, something she said would be a serious First Amendment problem.”
That latter point—that pregnancy help centers were targeted—is hugely important. There is no similar requirement (in reverse) for abortion clinics.

Of course, that proves nothing, other than that the justices are traditionally wary of compelling speech, but it is still encouraging.

As NRL News Today has written on many occasions, the 2015 law has particularly onerous provision. Locally funded pro-life medical clinics are compelled to advertise taxpayer-funded abortions. 

Specifically, the notice, which the law specifies must either be posted as a public notice in “22-point type,” “distributed to all clients in no less than 14-point font” or distributed digitally “at the time of check-in or arrival,” applies to all pregnancy help medical clinics licensed by the state.
“California has public programs that provide immediate free or low-cost access to comprehensive family planning services (including all FDA-approved methods of contraception), prenatal care, and abortion for eligible women. To determine whether you qualify, contact the county social services office at [insert the telephone number].”
And as Jay Hobbs of Pregnancy Help News explains pregnancy help centers that do not offer medical services will be required to post the following signage in two “clear and conspicuous” places—“in the entrance of the facility and at least one additional area where clients wait to receive services,” as well as in “any print and digital advertising materials including Internet Web sites”.

The font required is to be “in no less than 48-point type” and will read as follows:

“This facility is not licensed as a medical facility by the State of California and has no licensed medical provider who provides or directly supervises the provision of services.”
The absurdity of the law, particularly its reach, was captured in a back and forth between Justice Anthony Kennedy and a lawyer for the state (presumably Joshua A. Klein). 

NPR’s Nina Totenberg, pro-abortion to the core, nonetheless noted that Kennedy cited a hypothetical example of a billboard in Los Angeles with the words ‘Choose Life.’ He asked the lawyer for the state if it was paid for by an unlicensed facility if it would have to say so in large font and in multiple languages.

The lawyer for the state said that it would. For Kennedy, that seemed to be too much.

Why These Pregnancy Center Directors Are Asking the Supreme Court to Protect Their Free Speech

“You are pregnant.”

For a woman facing an unplanned pregnancy, those are life-altering words. And what she does in that moment, with this overwhelming information, could have a profound impact on the rest of her life. That’s where pregnancy centers step in.


Pro-life pregnancy centers exist to provide hope and help to women who are facing an unplanned pregnancy. They provide material resources such as diapers, wipes, clothing and formula to help the expecting mother prepare and provide for their baby. 

They also provide birthing and parenting classes for the men and women seeking to prepare for all that lays before them. The medically licensed centers – such as Alternatives Pregnancy Center, Options for Women, and Pregnancy Care Clinic – can provide pregnancy tests, ultrasounds, and STI testing.

Pregnancy centers exist to give women all the information and support they need to answer the questions that come after they find out that they’re pregnant. Often, these center directors say, that question is:

“What am I going to do about it?”

As these pregnancy center directors shared, the women who come into their center face unique situations. They all have different backgrounds and challenges. And there is no “one-size-fits-all” solution.

That’s why the pregnancy center staff listens to each woman, answers her questions, and discusses each of the options she is interested in: parenting, adoption, and abortion. They give these women the facts about each option, their benefits, and their harms. They give them the truth.

Often, the pregnancy center staff finds that these women feel they don’t have the necessary support to move forward with their pregnancy – even if they do want to keep their baby. Thankfully, these pro-life pregnancy centers help remove that barrier.

But the State of California won’t allow these conversations to happen naturally within each pregnancy center. Instead, the government is mandating that these centers start the conversation with every woman that walks through their doors the same way:

“Abortion is the answer.”

A California law mandates that pro-life pregnancy centers must post large signs in their waiting rooms or provide every woman with written notice that the state offers free or low-cost abortions, including a phone number where women can call to get more information. In other words, these pro-life pregnancy centers must advertise for the abortion industry in their own waiting rooms, sometimes even before they even get the chance to speak with the women.

This directly contradicts their mission and their reason for existing. And it changes the conversation with the woman, putting words in the mouths of the pregnancy center staff members.
That certainly doesn’t sound like free speech. Government should not have the power to compel Americans to speak a message that contradicts their beliefs.

Ex-Planned Parenthood VP Launches New Effort to Slam Pro-Life Centers

A new effort to undermine and oppose pro-life pregnancy centers offering women a chance to choose life over abortion is now underway, and this time, it’s a former Planned Parenthood vice president calling the shots.

Launched in the beginning of January, “Equity Forward” identifies itself on its online “About Us” page as, a project aiming, “to ensure transparency and accountability among anti-reproductive health groups and individuals who are actively working to deny women access to services.”

Later in its “About Us” page, the group says it “exists to create a window into what opponents of reproductive health care are doing, operationally and tactically, in order to expose malfeasance, fraud, unethical practices, and false information to hold them accountable.”

Led by Mary Alice Carter, a former interim VP for communications at Planned Parenthood, Equity Forward was approvingly profiled by The Hill Friday. The group has already kicked off its initial investigation meant to smear the nation’s 2,700 locally funded pregnancy centers that offer peer counseling, ultrasounds, material aid and post-abortive help offered at no cost.
“Rather than going on a wild goose chase against pro-life pregnancy help, abortion activists would do far better to investigate their own industry,” Jor-El Godsey, president of Heartbeat International—which serves over 2,400 pregnancy help organizations around the world—said. 
“Pregnancy centers are good for women and their children. It is abortion businesses—not pregnancy centers—that routinely physically harm their patients, profit off a woman’s desperation and break the law to maximize their bottom line."
“No woman has ever died or been harmed in a pregnancy center, and sadly, we can’t say the same about abortion businesses.”
Chasing the Wild Goose

Monday evening, a licensed private investigator named Jane Ebert called and left a message on the personal cell phone of a former pregnancy center employee who now works full-time with a national pro-life group. In her message, obtained by Pregnancy Help News, Ebert said she was working on an investigation on behalf of Equity Forward.

The message caught the former pregnancy center staffer off-guard, so she did a little digging into Equity Forward. She also reached out to her former colleagues at the pregnancy center and confirmed that Ebert hadn’t contacted any of them. As of Friday, Ebert had not returned a call or email from Pregnancy Help News.

While it’s likely the first time a pro-abortion group has enlisted the services of a private investigator, it’s nothing new for the abortion industry to probe into the pro-life nonprofits that serve well over a million women each year in the U.S. alone. In stark contrast to their pro-life counterparts who have exposed deep corruption in the abortion industry, pro-abortion “investigators”—some who pose as fake clients—have uniformly failed to back up their oft-repeated charges.

Unanimous 4th Circuit U.S. Court of Appeals Strikes Down Baltimore Law Targeting Pregnancy Care Centers

After seven years of litigation, covered extensively by NRL News Today, an unanimous federal court today affirmed a 2016 ruling by U.S. District Judge Marvin J. Garbis that a Baltimore ordinance targeting pregnancy care center violates the First Amendment—precisely the position taken by opponents of the ordinance.

“An ordinance passed in 2009 required pregnancy centers that oppose abortion to post a disclaimer in their waiting rooms that they don’t provide or refer people to abortion or birth control services,” according to Robert King.

In an opinion written by Judge J. Harvie Wilkinson III, and joined by Judges Allyson Duncan and G. Steven Agee, the panel ruled that the ordinance compelled a “politically and religiously motivated group [the Greater Baltimore Center for Pregnancy Concerns] to convey a message fundamentally at odds with its core belief and mission.”

The ordinance, “forces the center to utter in its own waiting room words at odds with its foundational beliefs and with the principles of those who have given their working lives to it,” he wrote. “Without proving the inefficacy of less restrictive alternatives, providing concrete evidence of deception, or more precisely targeting its regulation, the city cannot prevail.”

Indeed, in a stinging rebuke to the city of Baltimore, the decision directly challenged the city’s contention that the Greater Baltimore Center for Pregnancy Concerns, a nonprofit Christian organization, misled clients—had been “deceptive.”

“After seven years of litigation and a 1,295-page record before us, the city does not identify a single example of a woman who entered the Greater Baltimore Center’s waiting room under the misimpression that she could obtain and abortion there,” the court wrote.

The battle over the relentless pro-abortion campaign to compel pro-lifers organizations to promote abortion could be compelling to a head this year. The Supreme Court has announced it will hear National Institute of Family and Life Advocates (NIFLA) v. Becerra, the pro-life challenge to the so-called “Reproductive FACT Act.”

The law was pushed through on a strictly party-line vote from California Democrats and signed into law by Gov. Jerry Brown. As Jay Hobbs wrote, “While it has only been enforced in one jurisdiction—the City of Los Angeles—the law has since served as a template for a 2017 mandate in Hawaii, which would likely be affected by the Supreme Court’s forthcoming decision.”

Alveda King Regrets Her Abortion: “They Said It’s a Blob of Tissue and I Was Young and Foolish”

Alveda King, the niece of Martin Luther King Jr., continues her family legacy as a prominent human rights advocate.

A leader in the pro-life movement, King speaks across the globe about how abortion destroys lives and families. She knows from first-hand experience. King herself aborted two of her unborn baby when she was young.

The Pilot of North Carolina reports King shared her story Thursday at a banquet to benefit the Life Care Pregnancy Center in Carthage, North Carolina.
“Many of you may have read or heard that Alveda King is post-abortive,” King told the crowd. “In the 1960s and 70s, there was still a little game that the world was playing. They said that we don’t know when life begins, it’s a blob of tissue. I kind of believed that; I was young and foolish.”
King is not the only one who has been deceived by the abortion industry. Many women are deceived into believing that their unborn babies are not alive or important. Sometimes, they are told that they are just clumps of tissue or blobs of cells; but the truth is that from the moment of conception, unborn babies already are unique, living human beings. And by six weeks of pregnancy, their hearts already are beating.

King said her famous uncle was “very, very pro-life” and her grandfather was, too. Previously, King described how her grandfather encouraged her mother to choose life for her unborn baby – Alveda herself.

King encouraged people to support pregnancy centers like Life Care because they provide the help that women and babies so desperately need.
“The pregnancy care centers offer some wonderful alternatives,” she said. “By supporting a pregnancy care center, you actually support a lot of the entire (pro-life) movement.”
At a previous talk, she added: 
“I speak to women all the time that are seeking abortion. …Many times the answer will not be an abortion they are seeking — but just help, love and support and that’s the job of a pregnancy care center.”
Today, King is a mother of six and grandmother of six. As a Christian pro-life leader, she works with Priests for Life and the Silent No More Awareness Campaign to protect unborn babies and their moms from abortion and helps women like herself to heal from abortions in their past.

Knights of Columbus Sets Goal of Saving 1 Million Unborn Babies

The Knights of Columbus is taking its popular and successful ultrasound program to the next level with the goal of saving one million unborn lives with the help of technology that helps mothers to choose life over abortion.

Since 2009, Knights at the state and local levels have partnered with the Supreme Council in New Haven, Conn., to fund ultrasound machines for pregnancy care centers. They have so far placed 829 units in centers or in mobile medical units.
“We know from experience that a woman who sees an ultrasound image of her child is highly likely to keep her baby,” said Knights of Columbus CEO Carl Anderson at the organization’s 135th international convention in St. Louis.
Anderson recounted a conversation he had earlier this year during the dedication of a pro-life pregnancy center in San Antonio. A nurse practitioner told him that the first woman to use the new machine said her mind was already made up in favor of abortion.
“But then, as she watched the ultrasound,” recalled Anderson, “her baby turned and seemed to wave to her. She looked up at the nurse and said, ‘I’m going to keep my baby.’”
Anderson estimated that the machines have already saved hundreds of thousands of lives and set a new goal for the Knights to reach 1,000 machines in use by the time the Knights’ ultrasound program reaches its 10th anniversary in 2019. Knights-donated machines are already at work in all 50 states.
“If each machine saves the lives of just four unborn children each week, the Knights will have saved more than one million lives,” said Anderson. “Let us continue this great effort by reaching the goal of 1,000 machines as quickly as possible.”
Founded in 1882 by Venerable Father Michael J. McGivney, the Knights of Columbus has grown to nearly 2 million members, with charity as the organization’s primary mission. Last year, Knights donated $177.5 million and more than 75 million hours of service to charitable causes.

Court Shoots Down Forced Abortion Referrals

For a second time, courts in Illinois have expressed displeasure about the state's edict impacting pregnancy care centers.

State law forces pregnancy care centers in Illinois to post signs detailing where women can obtain abortions free or at low cost. Noel Sterett, an attorney with the law firm of Mauck & Baker in Chicago, tells OneNewsNow it also targets medical personnel.
"[Under the law] you at least have to tell the woman that abortion is a treatment option, and then tell her where she can get an abortion and the benefits of an abortion," he explains. "So this is essentially the government forcing or compelling speech of pro-life medical professionals and [in fact] explicitly targeting those doctors who have objections to these procedures."
So the law, he says, indicates the state doesn't care about conscientious objections or religious views.
Sterett explains that a federal judge has blocked enforcement of the law, but it's the second court-ordered injunction.
"The first injunction [that] we got on behalf of a select group of pregnancy care centers in state court ... wasn't as broad as this one because it only protected those pregnancy care centers involved in this case," says the attorney. "The federal court went a step further and says [it's] going to make a broad injunction protecting all healthcare professionals who have and want to exercise their right of conscience."
While the two injunctions don't necessarily mean both cases will be won, Sterett says it does give their clients encouragement that they won't have to sell abortions – which would be in direct opposition to their pro-life convictions.
