Let's Pass H.B. 1762, Admitting Privileges Legislation

On February 4, 2014, Rep. Bryan Cutler and the other leaders of the Pa. House Pro-Life Caucus (i.e., Rep. Jerry Stern, Rep. Bryan Barbin and Rep. Deberah Kula) introduced this legislation with 20 co-sponsors, which was assigned to the Pa. House Judiciary Committee.

This legislation requires abortionists to have admitting privileges at a hospital within 30 miles of the facility where they are committing abortions. (Use this link to view H. B. 1762)

The Good This Legislation Can Achieve

The implementation of this legislation can save women and children from abortion and close additional abortion facilities in Pa.

The implementation of this requirement in other states has resulted in the closure of abortion facilities because physicians committing abortions sometimes experience difficulty in obtaining admitting privileges.

What Can You Do To Pass H.B. 1762

2.  Please write Rep. Ron Marsico, the Chairman of the Pa. House Judiciary Committee, and ask him to run H.B. 1762, as soon as reasonably possible.

DOH Releases 2012 Pa. Abortion Report

On December 31, 2013, the DOH released the 2012 Pa. Abortion Statistics.  This report indicates the abortions declined in 2012 from 2011 by 1,744 or 4.8%.  I am attaching a copy of the summary sheet below.  The full Report is available on the DOH website using this link.

The DOH has had these 2012 statistics since April 2013, but has delayed releasing them for at least seven months.  However, this delay represents a relatively minor DOH deficiency.  I recently described some major DOH deficiencies (such as continuing to allow Pa. abortion facilities to cover-up sexual assaults on young girls) in a letter to Rep. Matt Baker, who is the Chairman of the Pa. House Health Committee.

Matt invited me to send this letter in our November 26, 2013 telephone conversation.  After I thanked Matt for his leadership to effect the closure of Steven Brigham's abortion chamber in Northeast Philly, I asked Matt for his assistance in effecting pro-life policies and practices at DOH in several other areas. 

2012 ABORTION STATISTICS SUMMARY

In 2012, there were 34,536 abortions performed in Pennsylvania. The 2012 figure is a 47.5 percent decrease from the 1980 total of 65,777 (the highest annual number ever recorded). The 2012 figure represents a decrease of 1,744 or 4.8 percent from the 36,280 that occurred in 2011. The lowest annual number of abortions occurred in 1999 (34,494).

Nearly all abortions in 2012 (32,075 or 92.9 percent) were performed in the first 14 weeks of pregnancy (first trimester).

Over 51 percent (17,754) of all abortions performed in Pennsylvania were to white women and 14,291 or 41.5 percent were to black or African American women. Abortions to women of Hispanic origin (regardless of race) accounted for 2,898 or 8.4 percent of all abortions in 2012.

Almost 89 percent or 30,702 of the abortions performed in Pennsylvania in 2012 were to unmarried women.

Patients age 19 and under accounted for 13.3 percent or 4,577 of the 2012 abortions performed in Pennsylvania. Females age 17 and under accounted for 4.2 percent or 1,438 of the 2012 abortions. The 2011 percentage for females age 19 and under was 14.3 and for females age 17 and under was 4.8. As in previous years, the largest single age group was 20-24, accounting for 12,098 or 35.0 percent of all 2012 abortions.
Of all the abortions that occurred in 2012 in Pennsylvania, 33,166 or 96.0 percent were performed on residents. The 2011 figure was similar at 95.0 percent. Residents of other states, territories and other countries accounted for 1,370 abortions in 2012, compared to 1,821 in 2011.

Of the abortion patients who resided in Pennsylvania, 13,659 or 41.2 percent were residents of Philadelphia. Other counties with a large number of resident abortions included Allegheny, 3,643; Delaware, 1,815; Montgomery, 1,642; and Berks, 1,594. Of all 67 Pennsylvania counties, 41 counties (61.2percent) showed a decrease in the number of resident abortions performed in 2012 compared to 2011.

Of the abortions performed in 2012 in Pennsylvania, 80.3 percent occurred in three counties -- Allegheny, Lehigh and Philadelphia.

In 2012, there were 146 reports of complications from abortions which were submitted by physicians, representing 33.9 percent more than the 109 reported in 2011. Over 79 percent of the complications in 2012 were related to retained products of conception, 11.0 percent to bleeding and 3.4 percent to infection.

Notes: The source for the number of abortions reported in Pennsylvania in 2012 is the "Report of Induced Termination of Pregnancy", which is an individual report filed for each procedure. The source for the complications data is "Abortions: Report of Complications", a separate reporting form completed by physicians who have provided medical care to a woman because of a complication resulting from an abortion or attempted abortion.

Unknowns are excluded from all calculations. 


Pennsylvania and Texas Lead Nation in Abortion Chamber Closures

2013 proved to be a record year of abortion chamber closures throughout our nation, with Pa. being second only to Texas.  Here is a link to  a December 30, 2013 article by Dr. Susan Berry from Breitbart.com that summarizes a recent report from Operation Rescue (OR) about these closures.  A complete copy of this report is available on OR's website.




Let's Improve in 2014!

We can increase the number of abortion chamber closures in our state in 2014 by passing the "Admitting Privileges" legislation, which Reps. Bryan Cutler and Bryan Barbin are co-sponsoring in the Pa. House.  Please ask your Pa. House Member to co-sponsor this proposed legislation.


It has been suggested that the best way to reach your Representatives is via fax as they often ignore e-mails (or "spam" them out) and dismiss phone calls, but they seem to respond most greatly to letters. BUT...letters are slower and sometimes need to pass through a lot of added security, especially at the federal level.  Fax numbers are included in contact information provided in the link above for most House Members.

Brigham's N.E. Phila. Facility Totally Closes!

 A Northeast Philadelphia pro-life activist reported today that, based on personal observations, Steven Brigham's "Integrity Family Health" (IFH) at 9622 Bustleton Avenue has totally closed.  Therefore, our public witness scheduled there for 11AM-12 noon on Wednesday, December 18, 2013 will not occur.

The Pa. Department of Health (DOH) granted IFH a license to commit abortions there despite their August 2010 order against Steven Brigham having any relationship with an abortion chamber in Pa.  On November 29, 2013, the DOH ordered IFH to stop committing abortions as of November 29, 2013.  However, IFH remained opened for abortion referrals and other "women's services."  Plus, IFH was taking abortion appointments for December 18, 2013.

But, the vigilance from pro-life activists and extra scrutiny from DOH likely prevented IFH from committing abortions.  The inability to commit abortions also likely led to IFH becoming not financially viable and, thereby, closing.

DOH Closes Steven Brigham N.E. Phila. Abortion Chamber

On Monday evening, November 25, 2013, the Pa. Department of Health (DOH) issued an order that directed the "Integrity Family Health" abortion chamber at 9622 Bustleton Avenue in Northeast Philadelphia to close by November 29, 2013. Because of this action, our scheduled public witness, from 11am-12 noon on Wednesday, November 27, 2013, will not occur.

Our President, Michael J. McMonagle,issued the following response to this Order. "We thank Gov. Corbett for correcting his Dept. of Health's mistake of granting a license to a new abortion facility in Pa. associated with Steven Brigham, who has an equally sordid record as Kermit Gosnell. We particularly thank Rep. Matt Baker, the Chairman of the Pa. House Health Committee, for his leadership to achieve this closure."

Rep. Matt Baker, who is the Chairman of the Pa. House Health Committee, provided excellent leadership to
achieve this closure. In my conversation with Matt today, in which I expressed our gratitude for this leadership, Matt stated that Gov. Corbett, once he became aware of his DOH's action of granting a license to a new Brigham-affiliated abortion chamber, acted in a strongly pro-life manner by directing his DOH to effect the closure of this abortion chamber. Matt also indicated his willingness to assist our ongoing efforts to improve DOH's other efforts of enforcing our state's abortion laws.

Pennsylvania Pro-Life Updates

The following is a discussion of these items.

1.  The Pa. Pro-Life Movement's Relationship with Gov. Corbett's Administration

I have previously expressed concerns and disappointments with the policies of Gov. Corbett's Administration in some recent e-mails.  On April 29, 2013,during a press conference in Philadelphia at the start of closing arguments in the abortionist Kermit Gosnell trial, I began to mildly, yet publicly, speak to these concerns and disappointments. These concerns and disappointments include the following:

A.  Despite his pledge as a candidate in 2008 and 2010, and that of his Deputy Policy Director in April 2011, Gov. Corbett continues to provide the same amount of state funds (a total of approximately $8.5 million) to abortion-committing organizations as did Gov. Rendell.  Gov. Corbett continues to decline to place language in his budget that would effectively eliminate such organizations from receiving state funds.

B.  Gov. Corbett's DOH continues to allow abortion facilities to cover-up sexual assaults on girls as young as 12.  As Pa. Attorney General, Tom Corbett stated that abortion facilities committed a crime if they failed to report pregnancies on a girl 12 or younger.  Now, Gov.Corbett's DOH refuses to investigate whether these reports are being filed.  His DOH now has the authority to withdraw the license from any abortion facility that fails to make these reports.

C. Gov. Corbett's DOH continues to allow abortion facilities to violate the informed consent laws by performing the required counseling in groups, by video and/or over the phone and/or by non-physicians.  The websites and Yellow Pages ads of our state's abortion facilities contain the evidence of these violations.

D. Gov. Corbett's DOH has out-sourced the accreditation of abortion facilities in Pa. to an organization in Illinois entitled the American Association for Accreditation of Ambulatory Surgery Facilities (AAAASF).  Act 122, which took effect in June 2012, requires such accreditation by AAAASF to be a necessary condition.  However, Gov. Corbett's DOH has interpreted this law to make such accreditation a sufficient condition.  Therefore, DOH has been accrediting abortion facilities in Pa. without ever inspecting them.

I plan to continue some private entreaties with Lt. Gov. Jim Cawley to change these bad policies.  

2.  A Proposal to Lower our State's Late-Term Abortion Limit from 24 to 18 Weeks

According to the 2011 Pa. Abortion Statistics, approximately 1,000 children were killed before birth by abortion in Pa. between 18-24 weeks.  Therefore, such a policy change would save lives.

Such a proposal also places the pro-life movement in the offensive and requires the other side to defend late-term abortions.  Such a proposal is another logical application of lessons learned from the abortionist Gosnell scandal.

In his 2007 opinion upholding Nebraska's ban on partial-birth abortion, Justice Anthony Kennedy, who provided the fifth vote in this case, invited further such challenges to Roe, based on stopping fetal pain. Other states have lowered their abortion limit and I propose that we also do so in Pa.

    
3.  Obamacare Abortion Opt-Out Legislation Advances

On May 7, 2013, the Pa. Senate Banking and Insurance Committee passed H.B. 818 by a 9 to 5 vote.  A vote by the full Senate on this legislation is likely to occur in the near future.

Please contact your State Senator as soon as possible and urge him or her to vote for H.B. 818 and against all weakening amendments.

4.  Report on the Struggle to Keep Abortion Out of Ireland

From May 9-19, 2013, I will be unavailable because I will be joining an international team of pro-life activists for a "Walk for Life and Justice" from Belfast to Dublin.  Many of us on this walk participated in the human rights protest in Tiananmen Square in Beijing just before the start of the 2008 Summer Olympics.  Unlike our experience in China, we do not expect to be deported from Ireland.

In June 2013, the Irish Parliament has scheduled a vote on legislation to legalize abortion for the "suicide exception."  The history of the exception (e.g., in California and Pennsylvania before Roe) is that thousands of "legal abortions" will result.

In 2011, in the wake of Ireland's economic downturn, their equivalent of the Democrats in the U.S. [Fine Gael (FG)] won a majority in the Irish Parliament (called the Dáil Éireann).  FG won on a promise not to legalize abortion in Ireland.  But, the current Irish Prime Minster (called the Taoiseach), Enda Kenny, has broken that promise and is leading an effort to legalize abortion in Ireland.  A brazen and massive lie by news media outlets about the death of a pregnant woman from India at a hospital in Ireland in December 2012, is aiding this effort.

The vote will be close.  Already at least 30 FG members have agreed to vote against Kenny's proposal.  However, similar to the U.S., some members of Fianna Fáil, the equivalent of the Republicans in the U.S. and allegedly "pro-life," might vote with Kenny.  In addition, the members of the Dáil from the Sinn Féin and the Labour Parties have committed to vote for legalized abortion in Ireland.  The website www.lifeinstitute.net provides a detailed explanation of this situation in Ireland.
