Mother Saves Her Baby’s Life Through Florida Safe Haven Law

Safe Haven laws save lives. Heartbreaking stories occasionally make headlines, of newborn infants abandoned and left to die — in bathrooms, in garbage cans, in sewers — because desperate mothers felt they had no other choice. But in Florida, one baby is still alive after a mother took advantage of the state’s safe haven law.

A mother approached a fire station in Davie, Florida, with her hours-old baby wrapped in a towel. The baby, a girl, weighed about six pounds and is said to be in good condition. The little girl will be placed for adoption, and the mother was able to safely surrender her baby and remain anonymous, with no questions asked and no repercussions. Battalion Chief Daniel Moran praised her for choosing to safely surrender her baby, saying that “moms in crisis should know it’s completely anonymous and in the best interests of the child” to bring newborns to authorities if they aren’t able to take care of them.

In Florida, mothers can bring their newborn to any hospital, emergency medical service station, or fire station, and surrender custody to any emergency medical technician, paramedic, or firefighter, and remain anonymous without any charges filed. The baby will then be taken to the hospital to receive medical care, and will be placed for adoption. Any medical problems needing treatment will be covered, as the state assumes the baby is eligible for Medicaid, and therefore will receive coverage. The baby will not be deemed as “abandoned,” as this would open the mother to investigation.

Almost every single state has some variation of a safe haven law, although some states — like California and Minnesota — are much stricter, limiting the places and the amount of time a mother can surrender her baby. Baby boxes are also a growing trend, started by firefighter Monika Kelsey, herself abandoned as an infant. In an interview with Live Action, she explained why baby boxes and safe haven laws are so important:

The Safe Haven Law, also called the Baby Moses Law in some states, is in effect in all 50 states and the District of Columbia. The law is in place to protect all parties involved. In most states, a woman has 30 days after birth to safely surrender the child at any fire station, police station, or hospital with no questions asked.

Baby Safely Surrendered at Fire Station Underscores Importance of 2018 Legislation

MICHIGAN CITY, Ind. – A baby was safely surrendered Sunday into a baby box at a Michigan City fire station. Under the Safe Haven Law, newborns up to 30 days old can be anonymously surrendered at fire stations, hospitals, and police stations. Indiana law also allows for the installation of baby boxes at hospitals and fire stations.

This is the second baby surrendered in this baby box. A baby girl was surrendered last November. There are two baby boxes in Indiana: the Coolspring Township Fire Department at the Woodburn Fire Station.

The Indiana General Assembly just passed Senate Enrolled Act (SEA) 340 that allows for the expansion of baby box installation at fire departments, including volunteer fire departments, that are staffed by an emergency medical services provider. Gov. Eric Holcomb signed the legislation into law on March 25.

The baby box at the Coolspring Township Fire Department was grandfathered into law during the 2017 General Assembly Session.
“We are pleased to learn of the baby saved in the Michigan City Fire Station baby box,” said Mike Fichter, President and CEO of Indiana Right to Life. “This is the second baby who now has a chance at life. We never want a mother to feel like she is in such a desperate situation that surrendering is her only option, but it is certainly preferred to illegal abandonment. “
Fichter added, “We commend our Indiana legislators and Gov. Eric Holcomb for recognizing the value in baby boxes. We encourage all eligible locations to consider installing and promoting them. Yesterday’s save underscores the importance of baby boxes.”
According to Safe Haven Baby Boxes, Inc., Indiana is the only state with baby safes. Since the baby safes were introduced in Indiana, there have been no deadly abandonments. The organization reports that babies have been saved after their guardians contacted the Baby Safe Hotline at 1-866-99BABY1.

Baby Saved at Texas Fire Station Under Safe Haven Law

A baby was brought to a Plano, Texas, fire station under Texas’ Safe Haven Law on May 18 and placed with a foster family.

According to ABC, a woman arrived at Plano’s Fire Station 1 on K Avenue around 11:30 in the morning. She told a firefighter that the baby was two days old and that she didn’t feel as though she could take proper care of the child.

The child was then taken to Children’s Medical Center Plano and found to be healthy. After Child Protective Services received custody of the child, the baby was placed in a foster home.

This is the third baby to be left at a fire station in Plano since the Texas Safe Haven Law took effect in 1999.

“I believe this is the ultimate act of love,” said Fire Chief Sam Greif. “This mother knew, for whatever reason, she could not provide the home that others so badly want to provide. I hope others that find themselves in her position will show the love and compassion she demonstrated.”
Under the Safe Haven Law in Texas, parents can leave an infant 60 days old or younger with an employee at a hospital, fire station, EMS station, child welfare agency, or freestanding ER if they decide they can’t care for the baby.

Safe Haven laws exist throughout the United States, but vary from state to state. Parents can drop the baby off anonymously without fear of arrest so long as the child has not been abused in any way. Safe Haven laws were put in place to protect babies from being hurt or killed by parents who believe they are unable to be a parent or who are at risk of abandoning their child.

Rather than place the child in a dumpster, as has has happened so often, parents can remain anonymous and keep their child safe. As of 2017, 3,317 infants have been saved through Safe Haven laws. More information on Safe Haven laws is available here.
