West Virginia Votes to Declare State Constitution Has No ‘Right to Abortion’

Pro-lifers won a major victory in West Virginia Tuesday, as voters approved a ballot initiative clarifying that the state constitution contains no “right” to abortion.

With 97% of precincts reporting in, Amendment 1 passed by a margin of 17,184 votes, West Virginia Metro News reports. It amends the West Virginia Constitution to include a line stating, “Nothing in this Constitution secures or protects a right to abortion or requires the funding of abortion.”

The measure is meant to counteract a 1993 ruling by the West Virginia Supreme Court of Appeals that has long forced Medicaid to fund abortions as a state-level constitutional "right.” While its success does not affect or override Roe v. Wade, it does ensure that the state Constitution can’t be used as a basis to strike down duly-enacted pro-life laws in the Mountain State.

Pro-life scholar Michael New hailed the referendum as the most consequential pro-life success of the election, noting it will directly save “hundreds” of babies annually:

Republican Senate candidates are having a good night, but in my opinion the most important pro-life victory was the passage of Amendment 1 in West Virginia. Stopping taxpayer funding for abortion will save hundreds of preborn lives every year!
“Over the years, West Virginia taxpayers have been forced to fund the destruction of more than 35,000 innocent unborn children – including late-term abortions – at a cost of nearly 10 million dollars. This outrageous abuse ends now,” Susan B. Anthony List president Marjorie Dannenfelser said.
“SBA List’s field team spent months on the ground in West Virginia educating more than 110,000 voters, urging them to vote yes on this vital initiative. The passage of Amendment 1 is a victory for the Mountain State and we hope other states will follow their lead.”
SBA List spent $500,000 this campaign season to educate West Virginia voters on the amendment’s importance.

Reforms such as Amendment 1 are also critical to guarding against a growing threat identified in July by pro-life activist Rebecca Kiessling.

West Virginia Senate Passes Bill Confirming There is “No Right to Abortion”

West Virginians are one step closer to adopting a constitutional amendment that makes it clear that their state does not recognize abortion as a “right.”

The state Senate gave its initial approval to state Senate Joint Resolution 12 on Thursday, and a final vote is expected Friday, according to the Bluefield Daily Telegraph. Abortion activists protested during the vote, some wearing red and white “handmaiden” robes.

To amend the constitution, the measure must pass the West Virginia Senate and House by two-thirds majorities and then a voter referendum.

Metro News reports a Senate committee amended the resolution, taking out part of the language. The resolution to be added to the state constitution would say, “Nothing in this Constitution secures or protects a right to abortion or requires the funding of an abortion.”

Another amendment that pro-life groups opposed failed to pass, the AP reports. West Virginians for Life said the “pro-abortion amendment … would have codified abortion in our state constitution.”
“SJR 12 is intended to make our constitution abortion neutral AND to disallow state funding. The bad amendment failed 22-7,” the pro-life group wrote online Thursday.
Here’s more from Metro News:

Senator Corey Palumbo, D-Kanawha, moved during Thursday’s floor session to amend back in language dealing with instances of rape, incest or protecting the life of the mother. His amendment wound up being defeated with 7 senators voting for it, 22 against and five absent.
“I think this is the first time the Constitution would be used to restrict rights in the state,” Palumbo said to his fellow senators.
Judiciary Chairman Charles Trump, R-Morgan, argued against Palumbo’s amendment, saying the resolution is meant to assure legislative say-so on abortion policy in West Virginia.

He said state code already reflects concerns about rape, incest or the life of the mother. Trump said keeping those instances in the state constitution would go against the intent of the resolution.
“Is there a constitution in any other state that expressly guarantees the right to abortion?” Trump asked.
State Sen. Robert Karnes, a pro-life Republican, told the West Virginia Metro News that they modeled the resolution after a Tennessee amendment that passed a voter referendum in 2014.
“There’s been no successful challenges whatsoever to the notion that it is the Legislature’s prerogative in the state of Tennessee to control abortion to whatever degree the Legislature wants to — under, obviously, the federal judicial umbrella that has made significant decisions related to abortion,” Karnes said.  “So what this would do for West Virginia would be much the same.”

Federally Qualified Health Centers Outnumber Planned Parenthood in West Virginia 28:1

By Carole Noveilli
Live Action News

Planned Parenthood operates just one facility in the state of West Virginia while Federally Qualified Health Centers (FQHC) operate in many more locations and offer a wider range of services. In the debate over funding the nation’s top abortion provider, it is important to be aware that several states have just one Planned Parenthood facility.

And while Planned Parenthood operates one center in West Virginia, in contrast, there are 28 Federally Qualified Health Centers providing services at 270 sites in the state, according to the Rural Health Info website.

In addition to having just one location, news reports indicate that the Vienna Planned Parenthood center in West Virginia, which refers for abortions, saw a minuscule number of patients compared to those seen by publicly funded health centers in the state.

While Planned Parenthood in WV saw approximately 960 patients in 2015, data published by Health Resources and Services Administration (HRSA) shows that in the same year, publicly funded health centers in the state saw almost 400,000 (399,213) patients.

Planned Parenthood, which masquerades as a health care provider, has been losing patients nationally as well.

In 2011, Planned Parenthood President Cecile Richards boasted that the organization served three million patients. By 2015, those numbers had dropped by more than 600,000 to 2.4 million. Nationally, the organization which now receives over $554 million in annual government revenue has been decreasing its services – all except abortion.

In FY 2014-2015, Planned Parenthood performed 323,999 abortions, accounting for 34.9 percent of the overall abortion market share in the United States. (This data is based on the latest abortion numbers published by Guttmacher.)

By FY 2015-2016, Planned Parenthood’s abortions rose to 328,348.

This was not the case for many other health services such as cancer screenings like Pap tests and manual breast exams, which decreased nationally at the abortion corporation.

In addition, Planned Parenthood’s latest annual report reveals that the organization’s contraception services are at their lowest in years (2,808,815), decreasing nationally nearly 30 percent since 2009, according to that year’s Annual Affiliate Service Census Report (4,009,549).
