Harvard Law Journal Concludes Unborn Babies Have Constitutional Rights

The Fourteenth Amendment, which was adopted in 1868, declares that no state shall “deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.” A debate that has been raging in courtrooms for years is whether the “life” part includes unborn persons.

Harvard Law student Joshua Craddock did some constitutional soul searching to answer that question in a new report for the Harvard Law Journal, concluding that unborn babies do fall under the Fourteenth Amendment’s protections.

One might look to dictionaries of legal and common usage, the context of the English common law tradition, and cases that attempted to construe the meaning of the text in a manner consistent with original meaning. Using this methodology, it is reasonable to construe the Fourteenth Amendment to include prenatal life. 
The structure of the argument is simple: The Fourteenth Amendment’s use of the word “person” guarantees due process and equal protection to all members of the human species. 
The preborn are members of the human species from the moment of fertilization. Therefore, the Fourteenth Amendment protects the preborn. If one concedes the minor premise (that preborn humans are members of the human species), all that must be demonstrated is that the term “person,” in its original public meaning at the time of the Fourteenth Amendment’s adoption, applied to all members of the human species.

In addition to using language to prove his point, Craddock puts his conclusions in context, noting that at the time the Fourteenth Amendment was written, several states called the unborn person a “child” in their anti-abortion laws. Moreover, The Stream notes, in 1859, the American Medical Association mandated that the government must protect the “independent and actual existence of the child before birth.”
Using this logic, Craddock notes, the Supreme Court justices were flawed in their 1973 ruling in Roe v. Wade, which granted the right to abortion. When he wrote the majority opinion, Justice Harry Blackmun failed to properly assess the word “person” as it was applied in 1868, Craddock argues.

Pro-Life Group Sues European Commission Over Democratic Deficit

NEW YORK, June 2 (C-Fam) A pro-life group is suing the EU Commission at the European Court of Justice, claiming the Commission usurped the democratic prerogative of the people of Europe when it turned down a pro-life petition with nearly two million signatures.

The Commission “rejected out of hand” the petition collected through a procedure known as European Citizens’ Initiative, or ECI. The Commission found the petition “irritating,” according to British barrister Paul Diamond, who represented the One of Us petition before the European Court of Justice last month.

“What we are asking is for this tribunal to give real effect to the ECI by protecting it from arbitrary refusals. We want you to protect the ECI from bureaucratic discrimination,” Diamond implored the court during oral arguments.

The petition requested action to ensure respect for human life from conception in EU policy and to stop funding for embryo destructive research as well as groups that promote abortion with EU development assistance money.

Five Things to Do This Summer to Support Life!

With the beauty of summer before us, it's a great time to sit back, relax, and contemplate what we might do to make the Summer of 2017 truly memorable. Many Millennials will head off for mission trips in faraway lands. But it is also possible to set off on a mission in your local community to help promote the cause of life. Here are five things you can do this summer to support life at all ages and stages of development:
1.) Volunteer to be a parent's personal assistant for the day. Your duties can run the gamut--grocery shopping, taking the children to an amusement park, gardening--any activity that can help brighten the day of a mother or father under stress. One study showed that as many as 80 percent of women who have had abortions would have chosen life for their children if at least one person had shown support for that choice. You can be part of a support system that supports life.
2.) Take up the tabling challenge! Sign up to staff a pro-life educational table at a fair or festival in your area. With the aid of soft-touch fetal models, informative brochures, and even smiley-face balloons, you can spread the pro-life message in a fun, creative way.
3.) Make your beach or backyard summer read one that promotes life. Unplanned by former abortion center director Abby Johnson and 40 Days for Life by the team behind that powerful prayer ministry of the same name are just two titles which can educate, motivate, and inspire on a sunlit summer's day.
4.) "Adopt" a grandparent for the day. Help an older person with their household chores. Visit a senior citizen in a nursing home. Make it fun--bring a homemade gift along, or play a board game while you're there. Honoring someone in the twilight of life is a wonderful way to respect life's dignity and inherent value.
5.) Attend--or make a promise to attend--a pro-life event. You have many incredible options here.

As pro-lifers, we can never take a vacation from the pro-life cause. Too many children, mothers, fathers, and grandparents are counting on us. By undertaking just a few pro-life projects this summer, or planning ahead for the fall, we can advance the cause of life in our own communities. We can rebuild a culture of life one smile, one heart, and one life at a time.

Lila Rose on Tucker Carlson: “The Public Deserves to Know What Abortionists are Actually Saying”

Last week, the Center for Medical Progress released a bombshell new video. In it, executives and abortionists from the National Abortion Federation and Planned Parenthood made callous, disgusting jokes about abortion, while also disclosing potentially illegal activity. 

The grisly admissions made on tape were horrifying, but the footage didn’t last long — YouTube quickly removed the video, and then U.S. District Court Judge William Orrick further forced the removal of the video and threatened to hold CMP in contempt for its release. Orrick’s actions were roundly criticized, not only by pro-lifers, but also by defenders of free speech and of journalists. On Wednesday, Fox News host Tucker Carlson addressed the apparent censorship, criticizing Judge Orrick for ordering the video to be removed. Carlson argued that Orrick intentionally “suppressed” the video and that this was an attack on the First Amendment.

Lila Rose, the founder and president of Live Action, also appeared on Carlson’s show. Rose argued that the horrifying nature of the video is exactly why Americans need to see it.

“Is the allegation that — I mean, the only way, it seems to be, that would be legitimate if you could keep something under wraps like this video, is if you could show that they’re not real,” Carlson said. “Is there any evidence these videos are not real?”
“I think precisely because they are real, is why there’s so much opposition,” Rose said. “This is National Abortion Federation and Planned Parenthood’s own trade show. This is where they get together and talk about what they do every day.”
“Planned Parenthood commits 900 abortions every day in this country,” she continued. “That’s 900 little boys and girls killed by abortion, by Planned Parenthood, every day. So the fact that they called — they asked Judge Orrick for the injunction, the fact that Planned Parenthood and National Abortion Federation so badly want these tapes to be kept quiet points to the — shows us that they’re very afraid of what’s on these tapes.”

Rose detailed the admissions and gruesome descriptions of abortion made by top Planned Parenthood staff: 
“The callous laughter about the abortion procedure, about tearing apart a child’s legs, taking the legs off from the navel when they’re delivering the child, that discussion by Planned Parenthood abortionists on the tapes, their discussion of the head getting stuck in the cervix and complaining about the abortion procedure…
 I mean, horrific, so difficult to hear. But this is exactly what the public should hear, Tucker, because Planned Parenthood, the very abortionists that are laughing about what they’re doing on these tapes, are receiving a half a billion dollars every single year from taxpayers.”

New York Magazine is Right: Every Pregnancy Center is a Threat to Big Abortion

Tune up the world’s smallest violin and get ready to bemoan the plight of the last remaining abortion business in Mississippi—which pays the rent by ending 2,300 unborn human lives every year.

Tonight’s tiny-stringed orchestra conductor, New York Magazine, set off a cacophony of pro-abortion sorrow Thursday with an article entitled, “A New Threat to Mississippi’s Only Abortion Clinic Moved in Across the Street” .

Soon, Mic.com and Romper.com had followed with similar pieces, decrying a new neighbor to Jackson Women’s Health Organization—an abortion clinic that has been a darling of the left and is the stomping grounds to self-styled Christian abortionist Willie Parker.

As first reported by Pregnancy Help News, the clinic now has a pro-life neighbor just 100 yards away, dedicated to giving a woman one last chance to save her baby and reject abortion.

While free ultrasound is the main tool the pro-life Center for Pregnancy Choices will use to help women choose life for their babies in the shadow of the pink-painted abortion mill, that fact is conveniently absent from the coverage by New York Magazine and friends.

In place of the facts, New York Magazine trots out old, baseless talking points from abortion fanatics at NARAL Pro-Choice America, accusing pregnancy centers of luring and lying to women “to persuade women into their center instead, often claiming that their centers can offer the services they may need.”

Along with NARAL’s trope, the author points to numbers pulled from the pro-abortion 2016 National Clinic Violence Survey in attempts to show that a pregnancy center’s proximity to an abortion clinic poses an actual physical threat to clinic staff.

Compiled by the Feminist Majority Foundation, the survey is deeply flawed, drawing self-reported responses from 319 abortionists around the nation and failing to corroborate the survey with any crime statistics whatsoever.
Far from putting abortionists at risk by locating near a clinic, pro-life pregnancy centers put themselves in harm’s way to give their clients a true choice.
While women are indeed often persuaded to go into a pregnancy center rather than an abortion clinic, there’s no question that decision has everything to do with what’s inside each type of facility.
At a pregnancy help center like Center for Pregnancy Choices, a woman will find free pregnancy testing, a free ultrasound, free options consulting that has zero profit motivation. Choices, in other words.
At an abortion clinic like Jackson Women’s Health Organization, however, what a woman will find is anything but choice. All she will find is an abortion because that’s all the clinic offers. That’s what keeps the lights on and the money flowing in, after all.

Amazing Photos Show Before and After Pictures of Premature Babies Born Before 24 Weeks

A powerful new photo series of children born at 24 weeks or earlier, holding birth pictures of themselves, is putting a spotlight on the need to protect unborn babies at this stage of pregnancy.

One beautiful baby girl, Callie, just celebrated her birthday, which is something denied to other children like her simply because of archaic state laws on abortion limits. Callie’s birthday came earlier than expected as she was born at just 22 weeks. In her home state of Mississippi, up until 2014, she still could have been legally aborted at the time of her birth.

Leah, born at only 23 weeks, is now a bright and beautiful teenager who loves to read and sing. She was born in Dallas, Texas, another state that recently updated their abortion limit to 20 weeks.

Other children in the photo series are from states that sadly still permit abortion past 20 weeks. Emma and Will, both born at 24 weeks, are now straight-A students from Pennsylvania, a state that still permits an abortion limit of 24 weeks, a law established in the 1980s.

Mississippi and Texas recently joined the growing list of now 21 states to update abortion limits to 20 weeks. However, this means that the majority of U.S. states still permit a policy that says you can abort a baby that would likely survive if simply given the chance. Only six other countries allow elective abortions beyond 20 weeks, including North Korea and China.

Medical advancements over the last several decades have greatly improved the survival rate of premature babies. What used to be a slim survival rate for babies born at 24 weeks is today seeing the majority of these babies being saved.

Congress is considering the Pain-Capable Unborn Child Protection Act that would place a 20-week abortion limit nationally. Scientific evidence suggests that after 20 weeks the baby is capable of feeling excruciating pain during an abortion procedure.

Several state legislatures are working to pass much-needed improvement to abortion limits. In Pennsylvania, Senate Bill 3 (which has already passed the State Senate) and House Bill 77 would update the state limit on abortion to 20 weeks (five-months in pregnancy).

‘Outrageous’: Pro-life Prayer Group Banned From Hospital

While the U.S. has struck down anti-life "buffer zones" on public sidewalks outside abortion clinics, Canada is still fighting pro-life free speech.

Court of Queen’s Bench Judge Reginald Leger issued a permanent injunction against 40 Days for Life pro-lifers seeking to peacefully pray and talk to women considering abortion outside Chaleur Regional Hospital in Bathurst.

Leger justified his decision by saying pro-life praying puts the safety of patients and employees at risk.
"This is outrageous and shameful," 40 Days for Life President Shawn Carney told LifeSiteNews. "In 2014, the U.S. Supreme Court struck down anti-free speech zones in Massachusetts, but Canada is fighting free speech like no one in the U.S."
"I wonder what kind of country these judges want," Carney added. "If you can't freely and peacefully gather on public property, then what can you do?"
On Monday, Ontario Attorney General Yasir Naqvi introduced legislation creating protest-excluded zones outside any facility that does abortions, including public hospitals.

Newfoundland and Labrador introduced buffer zone laws keeping pro-lifers 50 meters (164 feet) from abortion mills or face jail time. Naqvi's proposed legislation goes much further, establishing the entire sprawling hospital campus as an anti-free speech zone.

Heads Up on Rollback of Contraception Mandate

The New York Times is reporting that there exists a draft of a rule to undo the “contraception mandate.” It is not yet public, but we will let you know when it is.

At the moment, it is an “interim final rule,” meaning that it could become effective immediately on publication, but could also be altered in response to public comments (WSFT will submit official comments).

Pro-abortion and pro-contraception interest groups are preparing to challenge the rule. I cannot imagine a legal theory that could “require” the federal government to require religious groups to provide free contraception through their health insurance policies…but that is never a guarantee that some ideological judge won’t concoct one.

Planned Parenthood and others have said that they will argue that the new rule is “arbitrary and capricious,” or “impedes timely access to health care services,” or creates “unreasonable barriers to the ability of individuals to obtain appropriate medical care.”

Here are the reasons that these arguments are wrong, in case you need them.

A rule exempting religious institutions from providing contraception and early abortifacients cannot be “arbitrary and capricious,” given that the United States Supreme Court has said in the Hobby Lobby case, and indicated strongly in the Little Sisters case, that religion is “substantially burdened” by being forced to include such drugs and devices in its health care plans, and that the government has “less restrictive means,” to deliver these without hijacking religious insurance plans. 


It is ridiculous to argue that contraception and abortifacients are necessary “preventive health care services”—as the Obama administration insisted—when the preventive care task force on which the government relies for expert advice has never listed contraception as recommended “preventive care” even to today—more than 5 years after the mandate was issued.


It is ridiculous to argue that drugs and devices with so many side and health effects are “appropriate medical care.”
Five years post-mandate, even the rabidly pro-contraception-and-abortion Guttmacher Institute has acknowledged that sexually-active women’s usage of contraception has not changed. 


How could the mandate matter then—even according to supporters’ definitions of “health care" ? I will continue to keep you updated and prepared with arguments as this unfolds.
