Judge in David Daleiden Case May be Forced to Step Down Over Planned Parenthood Connection

By Steve Ertelt
Life News

The judge overseeing the lawsuits filed against the man responsible for exposing Planned Parenthood’s sale of aborted baby parts has been heavily criticized for his connections to Planned Parenthood. Now, the judge, who tried to censor further videos exposing the abortion industry, may be forced to step down as a result.

Last December 2017, the legal team for undercover citizen journalist David Daleiden, who exposed the abortion industry’s role in the trafficking of aborted baby body parts, filed a petition for an “extraordinary writ of mandamus” in the United States Court of Appeals for the Ninth Circuit.

The petition asked that the appellate court order that William Orrick, a San Francisco federal judge, step down from presiding over two lawsuits, owing to an apparent conflict of interest and other facts creating the appearance of bias.

On Wednesday, February 28th, a three-judge “motions panel” ruled that Daleiden’s “petition for writ of mandamus raises issues that warrant an answer.”

The panel ordered that the abortion groups suing Daleiden in Judge Orrick’s courtroom, namely, Planned Parenthood Federation of America, its many California-based affiliates as well as others, and the National Abortion Federation, file answers to the mandamus petition within 14 days.

The panel further directed that in their answers, the abortion groups “shall address the basis for the district court’s denial of

[Daleiden’s] motion for disqualification of Judge William H. Orrick under 28 U.S.C. Secs. 144, 455(a) and 455(b)(1).” And the panel specified that, “in particular,” the answers [shall] address Judge Orrick’s relationship with Good Samaritan Family Resource Center.”

The three-judge panel is comprised of Senior Circuit Judge William C. Canby, Jr., Senior Circuit Judge Stephen S. Trott, and Circuit Judge Paul J. Watford. They added in their terse order that Judge Orrick might also “address the petition if [he] so desires,” either by filing an answer in the 9th Circuit Court of Appeals or by issuing an order and serving a copy on the appellate court. Daleiden is to file a reply in 5 days after service of the answers, and all relevant papers “shall be referred to the next available motions panel.”

The order was to be served not only on Judge Orrick, but also on District Judge James Donato, to whom Judge Orrick had referred Daleiden’s initial motions for disqualification and who denied both of them.

Peter Breen, Thomas More Society Special Counsel, responded to the latest developments.

City Censored Pro-Life Man’s Signs, Now Judge Orders City to Respect His Free Speech

By Micaiah Bilger
Life News

A Michigan pro-life advocate may continue holding signs on the sidewalk after he settled a free speech case with a Detroit suburb Wednesday.

In 2016, city officials in Center Line, Michigan prohibited resident Michael Mattia from carrying his pro-life signs on city sidewalks, arguing that they were disturbing the peace on a “psychological level” because they showed graphic images of aborted babies.

A judge ruled in Mattia’s favor in December, and the two parties reached a final agreement in the case Wednesday, CBN News reports.

Center Line agreed to pay $50,000 for Mattia’s legal fees, as well as $1 to Mattia personally, according to the report.

In December, Judge David Lawson blocked the city from acting against Mattia.
“A complete ban on sidewalk signs cannot be said to leave open any alternative channels of communication. … Mattia has demonstrated the likelihood of success on his as-applied challenge to (the sign ordinance) because of the breadth of the ordinance and its panoptic muffling effect,” the judge wrote on Dec. 18.
Mattia carried signs showing images of aborted babies, along with phrases such as “Abortion: God Forgives and Heals” and “Women Do Regret Abortion,” according to the report.

Graphic images of aborted babies are controversial, even within the pro-life movement, but they are a protected form of free speech.

Governments across the world have been trying to chip away at pro-life advocates’ freedom of speech through buffer zones and other measures. In England, Australia and Canada especially, abortion activists have been trying to essentially silence pro-lifers who reach out to women outside abortion facilities.

Waco Action Agenda: Life Chain, 40 Days for Life, Yard Signs

from John Pisciotta, Director
Pro-Life Waco

1. Life Chain Outreach Sunday March 4, from 2-3 PM

Our next non-40 Days outreach is sending messages of life and love at the intersection of Valley Mills Drive and Waco Drive. Life Chain Sunday from 2-3 PM is such an enjoyable gathering. The weather should be nice. I'm hoping that we will have at least 20 pro-life foot-soldiers on site. The signs that we hold and place in the ground are important. Even more important is our personal presence as a witness defending babies in the womb and encouraging loving family life. Just come out and look for "Carolyn” the billboard truck parked near Pei Wei restaurant. We are permeating Central Texas with our passion for life. When we show our passion, that moves and inspires others. With you on board, we are growing the movement of hometown foot soldiers for life.

2. As Jesus was going up to Jerusalem
As Jesus was going up to Jerusalem,he took the Twelve disciples aside by themselves, and said to them on the way,"Behold, we are going up to Jerusalem, and the Son of Man will be handed over to the chief priestsand the scribes, and they will condemn him to death, and hand him over to the Gentilesto be mocked and scourged and crucified.
Jesus suffered immensely for you and I. Surely, we should be willing to suffer and sacrifice to defend the little ones he loves so tenderly. Just three weeks of the 40 Days for Life prayer vigil remain. If prayer participation at Planned Parenthood is possible for you, I would be elated to receive a message from you stating the time for one week or all three remaining weeks. If you are already praying, perhaps you can devote one more hour to prayer at Planned Parenthood. I was so encouraged this week to visit with prayer volunteers traveling from Calvert and Copperas Cove—over an hour from Waco. There are some hours when our prayer presence at 700 W. HWY 6 is modest, risking having hours uncovered. These are 11 to 1 on Mondays, 3-5 on Tuesdays, and 9 to noon on Fridays.

3. Yard signs and more yard signs

One of the goals of 40 Days for Life is "Community Outreach." The main way this is accomplished in Waco is with churches and residences displaying 40 Days for Life yard signs to let their neighbors know where they stand. Please pick up a yard sign for yourself or for a friend who will proudly display it. We have 40 Days yard signs in English and in Spanish. You may pick up a sign at the 40 Days for Life prayer vigil, at Life Chain outreach this Sunday, and at my doorstep of 4200 Grim Ave.

4. Abortions return to Waco Wed/Thurs/Fri—March 7/8/9

This is such a difficult message to bring to you. However, a completely comfortable Christianity is not possible for us. The abortionist will fly in from Cambridge, MA. We will have several prayer volunteers from 40 Days for Life on site at Planned Parenthood. The precious little ones and their moms heading in the wrong direction need as many prayerful Christians as possible. Could you come out to stand and pray in the gap? Come with a friend. Come with a family member.

Here are some photos of the 40 Days for Life prayer vigil in recent days.

YouTube Quietly Relies on Pro-Abortion Organization to Censor Content

By Jarrett Stepman
Life News

Silicon Valley has enormous power over the flow of information that reaches people around the globe. That’s why it’s vital for Americans to understand how tech giants can manipulate information, either intentionally or unwittingly, to advance a political agenda.

A report by The Daily Caller said that YouTube, which is owned by Google, is using the Southern Poverty Law Center, a left-wing activist nonprofit that bills itself as an objective civil rights organization, to assist in policing content on its video-sharing website.

In 2016, YouTube was accused of censoring PragerU videos, and more recently, Google was lambasted for creating a seemingly partisan “fact-checker” function for its search engine that almost exclusively targeted right-leaning media outlets.
“The left-wing nonprofit [SPLC]—which has more recently come under fire for labeling legitimate conservative organizations as ‘hate groups’—is one of the more than 100 nongovernment organizations … and government agencies in YouTube’s ‘Trusted Flaggers’ program,” according to The Daily Caller.
The Daily Signal asked Google if and why it has collaborated with the Southern Poverty Law Center, but it did not respond as of the time of publishing this article. A variety of media sources, including CNN and ABC, cite the Southern Poverty Law Center as an authoritative source on what can be defined as a “hate group.”

But the group has been very loose about how it defines hate, and often recklessly lumps mainstream conservative organizations in with Nazis and other extremist groups. Even Politico has warned that the Southern Poverty Law Center may now be overstepping its bounds by increasingly casting a wider net as its politics drift further to the left.

For instance, the Southern Poverty Law Center recently released a report on “male supremacy,” which it defines as an ideology that “misrepresents all women as genetically inferior, manipulative, and stupid, and reduces them to their reproductive or sexual function.”

The report listed a number of organizations it considers male supremacy “hate groups,” which included American Enterprise Institute scholar Christina Hoff Sommers. Sommers has questioned modern feminist orthodoxy, including the factual basis behind the allegedgender wage gap.

In an interview with The Weekly Standard, Sommers said of her placement on the list:
“I completely reject that. This is a group I used to admire. They once went after Klan members and Nazis and now … [they go after] people like Ben Carson and Ayaan Hirsi Ali. It’s absurd.”
“They’re blacklisting in place of engaging with arguments. They blacklist you, rather than try to refute you,” Sommers said.

We Must Never Forget, the Disabled Were the Nazis’ First Victims

“The horrific genocide of six million Jews
was in fact only the final chapter in the Nazi holocaust story.”

By Dave Andrusko
Life News

It can’t be said too often that we know very little about history–and what we do know often is either wrong or incomplete.

Over the years we’ve posted many stories that buttress and support what remain to many, many people an unknown historical truth–that “The Nazis’ First Victims Were the Disabled,” as an article published in the New York Times thoughtfully illuminates.

Kenny Fries, who is himself Jewish and disabled, writes about the connection between Aktion T4 [in which 70,000 people were selectively murdered], the Nazi “euthanasia” program, and the extermination of the disabled, explaining

I first discovered that people with disabilities were sterilized and killed by the Nazis when I was a teenager, watching the TV mini-series “Holocaust” in 1978. But it would be years before I understood the connections between the killing of the disabled and the killing of Jews and other “undesirables,” all of whom were, in one way or another, deemed “unfit.”

The [German] neurologist [to whom Fries is explaining his research] does not know much about what I’m telling him. While he does know that approximately 300,000 disabled people were killed in T4 and its aftermath, he doesn’t know about the direct connection between T4 and the Holocaust. He doesn’t know that it was at Brandenburg, the first T4 site, where methods of mass killing were tested, that the first victims of Nazi mass killings were the disabled, and that its personnel went on to establish and run the extermination camps at Treblinka, Belzec and Sobibor.
As Peter Saunders has so eloquently written,
“The horrific genocide of six million Jews was in fact only the final chapter in the Nazi holocaust story.”
The detail of how it happened, and particularly the role of doctors in the process, is not at all well known.

What ended in the 1940s in the gas chambers of Auschwitz, Dachau and Treblinka had much more humble beginnings in the 1930s in nursing homes, geriatric hospitals and psychiatric institutions all over Germany.

When the Nazis arrived, the medical profession was ready and waiting.

"These little ones dying today are intricately connected with the sufferings and death of Our Savior. There is a bond here that must not be overlooked. All the political action, educating, donation of funds, demonstrations, alternative work, important and necessary as these are, do not make up for an absence at the death scene. Thus, let me beg you to view your presence at the killing center in our area as the place where God wants you to be. Let us go out to the Calvary not far from you, where Christ is being crucified today in your midst"...Joan Andrews

Vice President Mike Pence: “I Truly Believe” Abortion Will be Abolished “in Our Time”

By Micaiah Bilger
Life News

With hard work and perseverance, abortion will be abolished “in our time,” Vice President Mike Pence said Tuesday.

Pence encouraged pro-life advocates during the 2018 National Religious Broadcasters Convention in Tennessee. He was a keynote speaker at a luncheon organized by Susan B. Anthony List and Life Issues Institute, which recently merged.
“I truly do believe, if all of us do all that we can, that we will once again, in our time, restore the sanctity of life to the center of American law. But we have to do the work,” Pence said, according to Newsweek.
He said the passion and love demonstrated by young pro-life advocates brings him hope for the future.
“I mean, for all the progress since 1973, the resilience of this movement proceeding out of the heart of a compassionate nation, I just know in my heart of hearts that this will be the generation that restores life in America,” he said.
In contrast, he said abortion activists have become increasingly radical. They have abandoned moderates who oppose late-term abortions and taxpayer-funded abortions, and are openly embracing abortion on demand. Pence mentioned the 20-week abortion ban as evidence; it narrowly failed in the U.S. Senate after pro-abortion Democrats and two pro-abortion Republicans rejected the moderate abortion limit.
“The truth of matter is the other side, the other party, continues to go farther and farther to the left,” Pence said.
The liberal Huffington Post acted surprised at Pence’s remarks, as if his pro-life stance is something new:

He called for the activists in the room to work ever harder to help “restore the sanctity of life to the center of American law.” He then made a stunning suggestion: that legal abortion could “once again” be banned in the U.S., and that it could happen “in our time.”

… the vice president announced that “life is winning in America once again,” before ticking off the many policies enacted under Trump aimed at limiting access to abortions.

Pence said Trump has kept his word about supporting pro-life policies, including the Mexico City Policy, which prohibits taxpayer funding to groups that promote or provide abortions overseas. Trump also signed a law that makes it easier for states to defund the abortion giant Planned Parenthood.
“[F]rom the very first day of this administration, President Trump has been keeping his word,” Pence said, according to the AP.
Pence is one of the most sincere and passionate pro-life advocates to ever serve in the White House. In 2017, he became the first vice president to address the March for Life. A former U.S. Congressman and governor of Indiana, Pence has a lengthy pro-life record that shows his dedication to protecting unborn babies and mothers from abortion.

A Chance Thursday to Listen to Webcast Discussion of an Important Supreme Court Case That Threatens Pro-Life Free Speech Rights

By Dave Andrusko
National Right to Life

For decades National Right to Life has warned about attacks on the free speech rights of individual pro-lifers and, of late, pro-life pregnancy help centers, in particular.

Over the last five years we have detailed one ham-handed attack after another, all of which have failed to meet constitutional muster either partially or in total, in places such as Baltimore, Montgomery County (MD), Austin (TX) and New York City.

Tomorrow, at 9 p.m. (EST), there will be a national webcast, hosted by the National Institute of Family and Life Advocates [NIFLA] which will bring together 16 prominent pro-life leaders, including NRLC President Carol Tobias, and 73 organizations to discuss the upcoming March 20 oral arguments before the Supreme Court in NIFLA v. Becerra. You can register in advance to listen at stopforcedabortionpromotion.com.

This case not only will decide the challenge to California’s so-called Reproductive FACT Act. As Alliance Defending Freedom, which is representing NIFLA in its challenge to a 2015 state law in California that forces pro-life pregnancy medical clinics to advertise abortions, has warned, the outcome will also determine “copycat and related mandates passed in Hawaii, Illinois, New York City, San Francisco and Hartford, Connecticut.”

This is a very, very important case and a wonderful opportunity for you to listen to the cream of the crop of those who are the front lines of defending the free speech rights of women-helping centers.

Register at stopforcedabortionpromotion.com and be sure to listen Thursday at 9:00 PM, EST.

After Birth Her Mother Left Her in a Dumpster to Die, But He Walked By and He Heard Her Cry

By Nancy Flanders
Life News

Morgan Hill spent the first few moments after her birth like so many of us do. She was cleaned up, wrapped up, and fed by her mother. However, it’s the shocking moments after this that changed the course of her life.

Mired in an extramarital affair, Hill’s biological mother was the only person who knew she was pregnant. She was determined to keep it that way.

While her husband was at work and her stepchild was at school, she secretly gave birth in the bath tub. After feeding her baby and wrapping her in a towel, she put her in the car and proceeded to drive around town, wondering what she should do next.

She ultimately chose to place her newborn baby girl in a garbage bag, tied with a double-knot and placed in a dumpster outside of a medical center in Hoffman Estates, Illinois.

It was a cool evening in October 1995. The dumpster was full and was scheduled to be picked up the next morning. Hill’s story could have easily and quickly ended right there in that dumpster. However—providentially—a nearby construction worker named Garold “Rocky” Hyatt heard a noise as he threw away some debris.

What Hyatt did next saved little Morgan Hill’s life.

“He heard a noise, heard it again, and saw the garbage bag move,” Hill told Pregnancy Help News. “He went into the medical center and said he believed there was a baby in the dumpster. The nurses ran out. One of the nurses, Carol Szafranski, picked up the bag, opened it, and found out it was a baby girl.”
The medical team rushed Hill into the medical center and named her “Mary Grace,” since they considered her a miracle from God. Over the next few days, law enforcement used surveillance footage to track down Hill’s birth mother and, eventually, her biological father as well.

As the story spread across news outlets nationwide, Hill’s biological father won a hard-fought battle for custody. But, already a single father, he eventually placed his baby girl into the hands of an adoptive couple he’d come to know and trust.

A Turning Point in Life

Hill grew up knowing she was adopted, but was unaware of her amazing journey into her family. At her high school graduation party, her niece made an off-handed comment that led Hill to press for the full story.

For the first time, Hill’s mother shared with her the heartbreaking first hours of her life.

“Over the 18 years, she’d kept a binder full of article clippings from newspapers, online, and pictures as well as records of my biological mother that she showed me to explain who I was as a newborn and what happened to me,” Hill said. “I did reach out to different places to find the people who cared for me as well as my biological father, and my mom was so supportive and so helpful with this.”
Hill was able to connect with her birth father—who had kept the same cell phone number for 20 years in hopes that she would call him one day. In 2016, at 20 years old, Hill met with a news reporter who helped reunite her with the first responders who saved her life.
